By accessing or using the CertCheck Most Loved Workplace® platform, you agree to abide by these Terms of Service. You must be at least 18 years old or acting as an authorized company representative to use our services. We may update these terms occasionally to reflect new features or legal requirements, and your continued use of the platform means you accept those changes.

CertCheck is a certification discovery and employer branding platform operated independently by the Best Practice Institute. We aggregate public data, process organizational assessments, generate helpful AI content, and distribute job listings. Our platform is designed to provide informational benchmarking and certification visibility. We do not offer legal, financial, or employment advice.

4. User Accounts & Registration

To access certain features, you may need to register an account. You are responsible for keeping your login credentials secure. We ask that you provide accurate information and maintain only one account per person. We reserve the right to suspend accounts that violate these terms or appear fraudulent. To manage a company profile, you must be a verifiable authorized representative of that organization.

5. Company Data & Profiles

Our platform aggregates publicly available information to create preliminary company profiles. We display this data "as is" for informational purposes, acting as a neutral information aggregator under Section 230 principles.

We encourage companies to claim their profiles. Once claimed, authorized representatives can update, edit, or submit new data at any time. We may combine the information you provide with our public data indexing to build a comprehensive picture of your workplace culture.

6. Certification & Badge Disclaimers

Our certifications are awarded based on an analysis of assessment data against our internal SPARK criteria at a specific point in time.

Please note that a certification is a recognition of organizational practices, not an endorsement, guarantee of quality, or strict recommendation for employment. While we strive for accuracy, our platform does not independently audit every claim made during the assessment process. Certification badges are time-limited and subject to annual renewal. We are not liable for employment or business decisions made based on a company's certification status.

7. AI-Generated Content

Here's what this means

We use AI to help draft engaging articles and reports about companies. While these tools are smart, they aren't perfect. We ask you to review AI content regarding your company and let us know if something needs adjusting.

We utilize artificial intelligence technologies, including services from OpenAI and Anthropic, to generate articles, reports, and social content. This content is provided for informational and marketing purposes and may occasionally contain errors or hallucinations.

We disclaim warranties regarding the absolute accuracy of AI-generated text. Users and companies should independently verify facts. We maintain the right to generate, modify, or publish AI content about any listed company, but this content does not necessarily represent the official views or opinions of the Best Practice Institute.

8. User-Generated Content License

When you share your testimonials, photos, logos, or assessment insights with us, you allow us to showcase your company's culture to the world. You retain full ownership of your original work.

By submitting it, you grant us a perpetual, irrevocable, worldwide, royalty-free, and sublicensable license to use, display, and distribute that content across our platform. We may also aggregate and anonymize your assessment data to create industry benchmarking reports. As a neutral platform hosting user testimonials, we operate under the protections of Section 230 and are not considered the publisher of user-submitted opinions.

9. Job Listings & Distribution

To help certified companies attract talent, we distribute job listings via XML feeds to partner platforms like Indeed, ZipRecruiter, Jooble, and Talent.com. We act solely as a facilitator in this process. We are not an employment agency and cannot guarantee placement visibility, traffic volume, or specific hiring outcomes. We are not responsible for how third-party boards display or format these listings.

10. Third-Party Services

Our platform integrates with excellent third-party services, including HubSpot, PeopleDataLabs, Resend, Salesmsg, and Gamma, to deliver a seamless experience. We are not responsible for the availability, practices, or privacy policies of these external services. Links to third-party sites are provided for convenience and do not imply an endorsement.

11. Data Scraping & Anti-Circumvention

We work hard to curate our directory. Unauthorized scraping, crawling, or automated extraction of data from our platform is strictly prohibited. The data presented here may not be resold or repurposed without our explicit written permission. You may not circumvent our security features or reverse engineer our systems. We reserve the right to take appropriate legal or technical action to protect the integrity of our platform.

12. Intellectual Property

The CertCheck platform, its underlying technology, and its original content are owned entirely by the Best Practice Institute. Most Loved Workplace® is a registered trademark. We are proud of our independent research and brand identity. We ask that you respect our intellectual property and only use our logos and branding when properly authorized through an active certification tier.

13. DMCA / Copyright Takedown

We respect the intellectual property rights of others and expect our users to do the same. If you believe your copyrighted work has been posted on our platform without authorization, please submit a valid DMCA notice to legal@bestpracticeinstitute.org. We maintain a policy to terminate the accounts of repeat infringers.

14. Confidential Information & Trade Secrets

We ask that you do not submit unauthorized confidential information or trade secrets into our public assessment forms or profile editors. While we secure your data, the platform is fundamentally designed to publish and celebrate employer branding details. We are not liable for the exposure of trade secrets that a user voluntarily submits. We may use aggregated, anonymized assessment data in our broader research publications.

15. Disclaimers & Warranty Exclusions

Here's what this means

We work hard to keep our platform running smoothly and provide valuable insights. However, like any online service, we cannot guarantee absolute perfection, uninterrupted access, or specific results. You use the service as it is provided.

16. Limitation of Liability

We want to be clear about the limits of our financial responsibility if something goes wrong. We cap our liability to ensure we can continue operating the service for everyone.

17. Indemnification

We are committed to building a safe community. By using the platform, you agree to indemnify and hold harmless Best Practice Institute, its officers, and employees from any claims, damages, or legal fees arising from your use of the service, your violation of these terms, or your submission of content that infringes on a third party's intellectual property rights.

18. Arbitration & Class Action Waiver

Here's what this means

If a serious dispute arises, we both agree to resolve it fairly through binding individual arbitration rather than taking it to a traditional court. This means we are both waiving the right to participate in class action lawsuits.

19. Force Majeure

Sometimes things happen outside of anyone's control. We are not liable for service delays or failures caused by events beyond our reasonable control, including acts of God, war, pandemics, major cyberattacks, or widespread internet outages.

20. Termination

You can stop using our platform at any time. We reserve the right to suspend or terminate your access if you violate these terms or if it is necessary to protect the platform and our users. Whenever possible, we will provide reasonable notice before termination. Certain provisions, such as indemnification and liability limitations, survive the termination of your account.

21. Governing Law

These terms are governed by the laws of the State of Florida. Any legal actions that are exempt from the arbitration agreement must be brought in the federal or state courts located in Florida, and you consent to their exclusive jurisdiction.

22. Severability & Entire Agreement

If any specific part of these terms is found to be legally unenforceable, that part will be modified or removed to comply with the law, but the rest of the agreement will continue in full force to protect both of us. These terms constitute the entire agreement between you and Best Practice Institute regarding the use of this platform.
